Structure note: Because the domain owner, service operator and SmartCubic operator are the same legal entity, customer-facing documents identify GLOBALIZ LTD as the principal operator. SmartCubic is described as an internal technology platform/brand rather than a separate contracting company.

Contract structure

GLOBALIZ LTD is the domain owner, service operator and SmartCubic platform operator for allbuilder.org. Accordingly, unless a separate seller, event organiser or payment recipient is clearly identified, “Company” in these Terms means GLOBALIZ LTD.

1. Purpose

These Terms govern the use of allbuilder.org and connected SmartCubic-enabled services owned and operated by GLOBALIZ LTD (“Company”) and set out the rights and responsibilities of the Company and users.

SmartCubic is a technology platform operated by the Company and is not a separate legal entity.

3. Definitions

“Service” includes education and training, events and conferences, content, search and connection features, posts, Cubic App and SmartCubic-enabled functions made available through allbuilder.org. “User” means a person or organisation accessing or using the Service. “Paid Service” means a course, event, item of content or other service requiring payment. “Third-Party Provider” means an independent person or organisation that actually supplies a specific course, event, item of content, product or service. “User Content” means content submitted through Comments, Cubic App, MetaCubic or another user-content feature.

4. Application and Changes

These Terms are made available through the Service or a linked legal page. The Company may update them when law, services, technology or operating arrangements change. Material changes affecting significant user rights or obligations will be notified in the manner required by applicable law.

5. Scope of Services

The Company may provide some or all of the following: education and training, conferences and events, preaching/textbook/program content, search, posts, Cubic App, SmartCubic ID, MetaCubic, Reward, CubicPass, Friend and Comment functions. Features may change for legitimate operational, security, legal or technical reasons.

6. Integrated SmartCubic Operation

SmartCubic is directly operated by the Company. Use of SmartCubic features on allbuilder.org does not mean that the service is transferred to a separate SmartCubic company. The Company may integrate functions within the same corporate service environment while complying with applicable purpose-limitation, notice and privacy obligations.

7. Accounts and Authentication

Where an account or SmartCubic ID is used, users must take reasonable care of authentication credentials. Users must not use another person’s account without authority or sell, transfer or lend an account. Suspected compromise should be reported promptly.

8. Education, Courses and Events

Courses, lectures, seminars and conferences may be delivered online, in person or in hybrid form. Dates, venues, instructors, delivery methods or supporting materials may change where reasonably necessary. Material changes will be communicated where practicable. Unless expressly stated, no particular academic, employment, income, search-ranking or business result is guaranteed.

9. Third-Party Instructors and Event Providers

Where a specific service is actually supplied by an independent instructor, organisation, church, event organiser or other third party, that party may be identified on the relevant page. A Third-Party Provider remains responsible, subject to applicable law and contract, for the content and performance it directly supplies. The Company’s responsibility for a third-party service is limited to its actual role and any responsibility imposed by law.

10. Pricing and Checkout

Before payment for a Paid Service, the Company seeks to identify the relevant service, amount, currency, payment frequency, actual seller/provider, payment recipient and material cancellation/refund terms. If a pricing error is identified, the Company may take reasonable corrective action to the extent permitted by law.

11. Payment Recipient

Unless expressly stated otherwise, GLOBALIZ LTD is the supplier and payment recipient for allbuilder.org Paid Services. PayPal or another payment service may be used. If an authorised partner or Third-Party Provider receives payment for a particular transaction, the actual recipient and role should be identified before payment is completed.

12. Recurring Payments

If recurring billing or automatic renewal applies, the amount, frequency, renewal arrangement and cancellation method will be displayed before authorisation. A user may cancel future automatic payments using the stated method, while refunds for a transaction already completed remain subject to the applicable transaction terms and law.

13. Cancellation and Refunds

Cancellations and refunds are governed by the conditions displayed for the relevant service and applicable consumer law. Nothing in these Terms limits a consumer remedy that cannot lawfully be excluded. Where a Third-Party Provider is the actual seller, that provider’s terms may also apply.

14. Company Content and Intellectual Property

Course materials, videos, documents, designs, software, brands and other content supplied by the Company or another lawful owner are protected by intellectual-property law. Except for permitted personal learning or service use, users must not copy, resell, redistribute, scrape or use them to build a competing service without authorisation.

15. User Content

Users must have sufficient rights to User Content they submit and bear primary responsibility for its legality and accuracy. To the extent reasonably necessary to operate the Service, users permit the Company to store, display, search, index, cache, format, resize and back up User Content on a non-exclusive basis.

16. Comments and Community

The author of a Comment bears primary responsibility for what they post. Fraud, deception, threats, harassment, abusive content, serious insults, spam, phishing, unlawful defamation, unauthorised personal-information disclosure, rights infringement and unlawful content are prohibited. The Company may reasonably restrict, hide or remove content for legal, security or moderation reasons.

17. Cubic App

A user creating icon-based information through Cubic App is responsible for the accuracy, legality and necessary rights or permissions for icons, titles, descriptions, URLs, images, logos, categories and search information. Malicious links, phishing, false affiliation claims, unlawful goods/services and rights-infringing content are prohibited.

18. MetaCubic and Public Information

Information a user chooses to make public through MetaCubic or another public feature may be accessible to internet users. Do not publish information you want to keep private. If a telephone number is optional, consider using a business/public contact number instead of a personal mobile number when public contact is needed.

19. Reward and Connection Functions

Reward, Friend and other SmartCubic functions operate subject to their applicable interfaces and policies. Unless expressly stated otherwise, Reward is not legal tender, a bank deposit or an investment product. Reward or connection functions must not be used for fraud, spam, unauthorised profiling or personal-information harvesting.

20. Minors

Minors should use the Service with age-appropriate parent or guardian guidance where appropriate. Home addresses, school details, personal telephone numbers, precise location, financial or identification information should not be unnecessarily posted publicly. Where Korean privacy law applies and consent is required to process the personal information of a child under 14, the legally required representative-consent and verification process will be followed.

21. Prohibited Conduct

Hacking, account takeover, phishing, malware, interference with the Service, unauthorised scraping or bulk harvesting, unauthorised collection or sale of personal information, intellectual-property infringement, fraudulent event/payment activity, impersonation, unlawful advertising and other unlawful conduct are prohibited.

22. Suspension and Content Action

The Company may reasonably restrict content or functionality and suspend account access where necessary for fraud prevention, security, legal compliance, material breach, rights protection or protection of other users. Where the matter is not urgent, an opportunity to remedy may be provided where appropriate.

23. External Links and Third-Party Services

The Service may link to PayPal, external websites, video/education resources or other third-party services. Those services may have independent terms and privacy policies. A link or technical connection alone does not constitute a guarantee or endorsement of all external content.

24. Privacy

Personal and customer information is processed in accordance with the separately published allbuilder.org Privacy & Customer Information Protection Policy.

25. Availability

The Company seeks to maintain reasonable service stability and security. Temporary interruptions may occur because of maintenance, security measures, internet or external-service failures, force majeure or circumstances beyond the Company’s reasonable control.

26. Scope of Liability

The Company remains responsible for obligations imposed by applicable law in relation to services it directly supplies. To the extent permitted by law, the Company is not responsible for indirect or consequential loss arising from a user’s particular circumstances or for performance of a service directly supplied by an independent third party beyond the Company’s actual fault or legal role. Nothing excludes liability that cannot lawfully be excluded.

27. Consumer Rights

New Zealand consumers may have mandatory rights under legislation including the Fair Trading Act 1986 and Consumer Guarantees Act 1993. These Terms do not purport to limit such rights in a manner that is not permitted by law.

28. Governing Law and Disputes

Subject to any mandatory law applying to a particular user or transaction, these Terms are governed by New Zealand law. Users and the Company should first attempt reasonable resolution through customer support. Unresolved matters may use any dispute-resolution process or court available under applicable law.
